Standards for Class 3 Accessory Apartments

Where an Accessory Apartment (AA) is allowed as a limited use:

(1) Only one AA is permitted for each lot;

(2) The AA must be approved and satisfy conditions of Special Exception approved before May 20, 2013;

(3) The AA must be licensed by the Department of Housing and Community Affairs if it does not have a Special Exception

(4) AA cannot be located on a lot with any short-term rentals

( 5) AA must be at least 500 feet away from any other AA in RE2, RE2C, RE1 and R200 zones;

(6) AA must be at least 300 feet awy from any other AA in RNC, R90 and R60 Zones;

(7) Hearing Examiner may grant waiver from parking and distance separations. Effective May 20, 2013, a Special Exception is not required for all Accessory Apartments. For further information regarding the creation or licensing of an Accessory Apartment, please click on the link below.
