Smoking Ban Law, County Owned or Leased Property Including: Outdoor Dining Areas; Bus Shelters and Parking Garages

Montgomery county's smoking ban law (Bill 33-12, MC Code 24-9), prohibits smoking on County owned or leased property. This includes smoking in County vehicles; County buildings; and bus stops with or without shelters, as well as County owned parking garages.

Violations at County buildings should be reported to the building manager. Employees smoking in County cars should be reported to their immediate supervisor, or department head. Smoking violations at bus stops and similar violations should be reported to Health and Human Services, Licensure and Regulatory office.

Bill 35-38 prohibits smoking or vaping in any outdoor dining (eating establishment) area, however a smoking area may be designated on a roof top or balcony. The outdoor dining area of a golf course is exempt from this ban if employees do not serve food in the outdoor area.

Municipalities that have already enacted bans on smoking in outdoor dining areas are exempt from provisions of this law.
