The control period is a set period of time that begins on the settlement date of the initial sale of the MPDU and ends 10, 15, or 30 years into the future, depending on when the MPDU was purchased. Generally, if the MPDU was purchased before 2005, the control period is either 10 or 15 years. If the MPDU was purchased after 2005, the control period is 30 years.
Purchasers of MPDUs sign what is called Receipt of Chapter 25A and MPDU Covenants, a document that outlines certain restrictions for the MPDU: During the control period, MPDU owners must live in the MPDU, cannot rent out the MPDU, and if the owner chooses to sell the MPDU, it must be sold through the MPDU program at a price determined by the County.
If an MPDU was initially offered by the builder through the MPDU program after March 20, 1989, the owner may sell the unit on the open market for a fair market price once the applicable control period has expired. The MPDU owner is required to share one-half of the ?Excess Windfall Profit? with Montgomery County.
