Report an Unlicensed Rental Property

All rental dwellings located in Montgomery County must be licensed by the Department of Housing and Community Affairs Licensing and Registration Unit. Property owners who fail to license a rental dwelling are subject to the issuance of a Class "A" Citation which carries a $500 fine.

If a property is not licensed, a landlord should not be renting and thus not collecting rent or late fees. If a tenant is renting a non-licensed property and does pay rent, the tenant does not have the right to have the rent returned during the time that the landlord was not licensed unless the tenant can prove that the lack of licensure caused them actual injury or loss. Currently, if a landlord is unlicensed, they cannot obtain an order of possession of the property in Court, whether it be via failure to pay rent, tenant holding over, breach of lease, etc. Online customers may report a suspected unlicensed rental property by clicking on the "Create Service Request" button below.
