Tenant can terminate lease early by giving 30 day?s notice to vacate in one of the following situations:
- Involuntary change of employment ? generally 25 miles
- Death of a major wage earner
- Unemployment
- Tenant or Tenant's child victim of domestic violence
- Landlord harassing the Tenant or violating the Tenant?s privacy rights
- Tenant or Tenant's spouse is over 62 years and can no longer live independently and needs to move into assisted living
- Tenant incarcerated or declared mentally incorporated
- Any other reasonable cause beyond the tenant's control.
- With DHCA permission- if LL failed to make repairs required by Code and that DHCA deems is threat to health and safety of the tenant.
The Notice to Vacate must explain the situation and provide evidence. The T will still be responsible for rent during notice period and can be liable for termination fee not to exceed 1 month's rent or actual damages sustained by the Landlord because of the breach, whichever is less.
