Addressing stream erosion on private property is typically the responsibility of the property owner. Any work within a stream is subject to State permitting requirements through the Maryland Department of the Environment. County staff members from the Department of Environmental Protection (DEP) can follow up to help determine if the erosion is on the caller's property. For properties not owned by MNCPPC (Parks), Montgomery County Public Schools, or another local, state or federal government, DEP staff can also assess the severity of erosion and provide recommendations.
For inquiries requiring the response of a DEP investigator, requestors will typically be contacted within 3 days although resolution of the issue may take longer depending on the circumstances of the case.
