Report a Maintenance Problem in a Stormwater BMP or Pond

The Department of Environmental Protection (DEP) handles complaints regarding the maintenance and condition of Stormwater Management BMPs (best management practices). Stormwater Management BMPs remove pollutants from runoff, prevent stream damage and erosion, and minimize flooding. These BMPs can be found above ground, such as ponds and bioretention; or underground, such as underground storage structures and filters. Maintenance of stormwater management BMPs on private property is the responsibility of the property owner or shared between the property owner and the County.

The DEP Stormwater Management BMP Inspection and Maintenance (SWIM) Program will investigate the complaint and contact the property owner if remediation or repair is required for the stormwater BMP. DEP is NOT responsible for the maintenance of stormdrain conveyance in the public ROW. Users should contact DOT for stormdrain maintenance questions.

For inquiries requiring the response of a DEP investigator, requestors will typically be contacted within 3 days although resolution of the issue may take longer depending on the circumstances of the case.

DEP will respond to complaints about stormwater management BMPs inside Montgomery County but does not have jurisdiction inside the municipalities of Gaithersburg, Rockville, and Takoma Park
