The Office of Zoning and Administrative Hearings (OZAH) conducts hearings in re-zoning and Conditional Use (formerly known as special exception) cases. OZAH makes the decisions in conditional use cases, but aggrieved parties have 10 days thereafter to request oral argument before the Board of Appeals (BOA). Hearing Examiners are not permitted to speak with anyone about the substance of a rezoning or conditional use case outside of the hearing record. In rezoning cases, the County Council makes the decision, based on a report and recommendation written by an OZAH Hearing Examiner, after a public hearing. County Council members are not permitted to speak with anyone about a re-zoning case outside of the public meeting where the Council members vote on the case, and they are not permitted to read anything about a rezoning case, such as a comment letter, unless it is included in the record prepared by the Hearing Examiner. Inquiries about how a person?s property is zoned, what development may be permitted under the zoning, or what permits may be required must be addressed to the Zoning and Site Plan Enforcement Division of Department of Permitting Services (DPS). All applications for rezonings or conditional uses must be reviewed for completeness by the Montgomery County Planning Department (301.495.4651) BEFORE being filed with OZAH.
