In such cases, the developer and/or contractor should contact the Department of Permitting Services' (DPS) Zoning & Site Plan Enforcement Section (Z&SPE) to document the situation. The developer and/or contractor are responsible to appeal to the Maryland-National Capital Park & Planning Commission (M-NCPPC) to change or amend the Certified Site Plan if any requirement(s) of the Certified Site Plan cannot be met. A hearing is held by the Planning Commission to determine if the developer or contractor may make a change to the certified site plan. Enforcement action by DPS Z&SPE may be taken until all Certified Site Plan requirements are met.
