Grass and weeds on private property may not exceed 12 inches in height. The Department of Housing and Community Affairs (DHCA) enforces this code on privately owned property (residential, unimproved lots, commercial). Tall grass in the median or County right of way is handled by the Department of Transportation (DOT). See Section 26-9 (b(5)) of Chapter 26, Housing and Building and Maintenance Standards on the attached URL link. DHCA Housing Code Enforcement does not have jurisdiction inside the municipalities of Gaithersburg and Rockville. Complaints regarding rental properties within the City of Takoma Park are also handled by DHCA but complaints regarding commercial or owner occupied properties within the city limits are handled by the City of Takoma Park. If the property is occupied, a case will be opened and the owner will be sent a letter advising them to cut tall grass and weeds. PLEASE CALL BACK IF GRASS HAS NOT BEEN CUT WITHIN 10 DAYS OF THE INITIAL COMPLAINT.
To file a complaint, please provide a brief description of the problem, the address where the violation is occurring, along with a specific location (if applicable). The caller's name and phone number are requested so that the inspector can call and provide an update of their findings The exact property address of the alleged violation must be provided to file a complaint.
Inspections are typically conducted within 5 business days (dependent on urgency, existing schedule, and caseload). Ultimate resolution can take many weeks and even longer for cases that must be referred to court.
